Access to certain sections of this site and/or any enquiries or requests for service submitted by the users of this site may be subject to the provision of personal data, whose handling by Maletti 1867 S.r.l. (hereinafter referred to as “Maletti 1867”), as Data Controller, shall be carried out in compliance with Legislative Decree 196/2003 “Italian Personal Data Protection Code” (hereinafter referred to as the “Code”).
This informative note is provided to inform users, prior to their accessing the various sections of the site and supplying their data, as to how Maletti 1867 will handle their personal data; users are required to take note of this before providing their personal data by filling in the gaps in the various sections of the site.
Purposes of the handling
Depending on the requirements specified by the user every time they access the various sections of the site, the processing of the personal data provided directly by the users by completing the on-line forms may have any of the following purposes:
a) to permit registration in the site, which is required in order to access particular sections of the said site and for the provision and management of the various services offered;
b) subject to the user’s consent, and until the revocation thereof, to carry out marketing activity such as (non-exhaustive list of examples): sending promotional and advertising material, and carrying out connected analysis of registered users which enable Maletti 1867 to improve its services and the products offered to its clientele; this may also be performed via:mail, fax, mms and sms, subject to specific consent and until the revocation thereof;
c) to send newsletters containing updates on the site’s contents, recipes, menus, nutritionist’s advice, and a range of other news from the world of Maletti 1867 and Italy’s finest cuisine (“Newsletter Subscribers” section in the site);
d) to meet the users’ requests concerning Maletti 1867 products, advertising or the site (“Contacts” section in the site).
Users are not required to register with the site to make use of any of the services offered by Maletti 1867 (e.g. those stated earlier in sections c) and d). Nevertheless, in order to process any enquiries from users regarding these services, users will be asked to supply personal data, which will be handled solely for the relative purposes and for as long as is strictly necessary.

The personal data shall generally be handled automatically, with the application of logics strictly correlated to the aforesaid purposes.
Nature of the provision of users’ personal data
The data is provided voluntarily, but the provision of part thereof may be necessary (i.e. the data marked by an asterisk) for Maletti 1867 to satisfy the users’ needs in terms of site functionality. Failure to provide the personal data marked with an asterisk, or provision of inaccurate or incomplete data of this kind, shall prevent the performance of the services requested as the aforesaid data is essential therefor; while failure to provide the non-essential personal data provided voluntarily, or provision of inaccurate or incomplete data of this kind, shall not have any consequences.
Categories of personal data subject to handling
In addition to the personal data supplied directly by the users (such as first name, surname, postal address, e-mail address, etc.), during connection to the site, the information systems and software procedures concerned with site functioning indirectly acquire certain personal data that is transmitted implicitly during the use of Internet communication protocols.
This data is only processed for the purpose of carrying out anonymous statistical surveys.
Categories of subjects to which the user’s personal data may be disclosed
The personal data may be disclosed to employees of or collaborators working with the Data Controller’s Marketing Department whom, operating under the direct authority of the latter, are appointed to manage or process the data in compliance with articles 29 and 30 of the Code and who shall have received appropriate operating instructions; the same training shall be given – by the managers appointed by the Data Controller – to the employees or collaborators working with the Managers.
Scope of communication or dissemination of the users’ personal data
The personal data provided directly by users by completing on-line forms shall not be either communicated to third parties or disseminated.

Users’ rights acknowledged by art. 7 of the Code
Article 7 “Right to access personal data and other rights”
1.A data subject is entitled to obtain confirmation as to whether or not personal data concerning him/her exists (even if not yet on file) and communication of such data in intelligible form.
2.A data subject is entitled to know:
a) the source of the personal data;
b) the handling purposes and methods;
c) the logic applied in the event that processing is carried out using electronic instruments;
d) the identification details of the Data Controller, the managers and the designated representative in the territory of the Italian state, where envisaged;
e) the entities or categories of entities to whom or which the personal data may be communicated and who or which may get to know such data in their capacity as designated representative in the territory of the Italian state, manager(s) or persons appointed to process the data.
3. A data subject is entitled to obtain:
a) updating, rectification or, where interested therein, integration of the data;
b) erasure, anonymization or blocking of data that has been processed unlawfully, including data whose retention is unnecessary for the purposes of which it has been collected or subsequently processed;
c) certification to the effect that the operations as per letters a) and b) have been notified, as also related to their contents, to the entities to whom or which the data was communicated or disseminated, unless this requirement proves impossible or involves a manifestly disproportionate effort compared with the right that is to be protected.
4. A data subject is entitled to object, in whole or in part:
a) on legitimate grounds, to the processing of personal data concerning him/her, even if it is relevant for the purpose of the collection;
b) to the processing of personal data concerning him/her, where it is carried out for the purpose of sending advertising materials or direct selling or for the performance of market or commercial communication surveys."The above rights may be applied directly or by granting (in writing) a proxy or power of attorney to physical persons or associations."

Furthermore, if the user has provided his/her consent, they may object to the handling for the purposes specified in section b) carried out via the user’s e-mail address by clicking the link provided in each e-mail.
User profile editing procedure
